These Terms of Use govern your use of aegiscoat.com (the "Site"), operated by AegisCoat, Inc. ("AegisCoat," "we," "us"). By using the Site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Information only, not an offer or warranty

The Site describes our materials and the results of laboratory, field and third-party testing. Results depend on the stated test conditions, substrates, application methods and environment, and your results may differ. Content on the Site is provided for general information. It is not an offer to sell, a specification, or a warranty or guarantee of performance, fitness for a particular purpose or regulatory status. Any commercial relationship is governed only by a written agreement signed by AegisCoat. You are responsible for evaluating suitability and regulatory compliance for your own use.

Intellectual property

The Site and its content, including text, graphics, images, video, data, logos, and the AegisCoat, Aegis-Bio, Aegis-Clear and Aegis-Gel names, belong to AegisCoat, its licensors or the University of Michigan, and are protected by intellectual property laws. Third-party names, photographs and marks belong to their owners and are used with permission or for identification. You may view and share links to the Site and download our published data sheet for your own business evaluation. You may not copy, modify, distribute or create derivative works from other Site content, or use our names or logos, without our written permission. Nothing on the Site grants a license under any patent or other intellectual property right.

Acceptable use

You agree not to use the Site to break the law, to interfere with or disrupt it or its security, to scrape or harvest it in bulk, to introduce malicious code, or to submit information that is false or that you have no right to share.

Your submissions

If you send us information through a form or by email, you confirm that you have the right to do so and that we may use it to respond to you and operate our business as described in our Privacy Policy. Please do not send confidential or proprietary information through the Site unless we have a signed confidentiality agreement with you. Samples, pilots and technical exchanges are handled under separate agreements, such as an NDA or MTA.

Third-party links and services

The Site links to third-party websites and uses third-party services such as HubSpot and Cloudflare. We do not control and are not responsible for them.

Disclaimer

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, AegisCoat and its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site or reliance on its content. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. You and AegisCoat agree to the exclusive jurisdiction of the state and federal courts located in Washtenaw County, Michigan, for any dispute relating to the Site.

Changes

We may update these terms from time to time. The effective date above shows when they last changed. Your continued use of the Site after a change means you accept the updated terms.
